Terms of Service

These Terms govern access to Lumsian, including subscriber accounts, paid tiers, private community features, live sessions, messages, uploads, payments, and related services.

Agreement to These Terms

By creating an account, buying a subscription, clicking that you agree, or using Lumsian, you agree to these Terms. If you do not agree, do not create an account, purchase access, or use the platform.

Eligibility

You must be at least 18 years old to create an account, purchase a subscription, join paid community features, use direct messaging, use private calls, upload content, or participate in member-only areas. Lumsian is not intended for children under 13.

Covered Services

These Terms apply to Lumsian websites, subscriber dashboards, paid tiers, posts, archives, releases, live sessions, replays, community rooms, direct messages, uploads, voice features, payment flows, and future services that link to these Terms.

Accounts

You are responsible for accurate account information, keeping your credentials secure, and all activity under your account. You may not sell, share, transfer, or assign your account without written permission from Lumsian.

Subscriber Access

Some features require a paid subscription or a specific subscriber tier. Access may vary by tier, payment status, availability, location, event schedule, moderation status, or technical limits. Lumsian may add, remove, archive, reschedule, or discontinue content or features.

Payments and Renewals

If you buy a subscription, you authorize Lumsian and its payment providers to charge your selected payment method for the price, taxes, fees, and renewal charges shown at checkout. Unless stated otherwise at checkout, subscriptions renew automatically until canceled.

User Content

User Content means anything you submit, upload, post, send, stream, record, or otherwise provide through Lumsian. You keep ownership of your User Content, but you grant Lumsian a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, moderate, remove, and use it as needed to operate, protect, improve, and provide the platform.

Prohibited Conduct

You may not misuse Lumsian or use it in a way that violates law, third-party rights, these Terms, or any linked policy. This includes harassment, threats, impersonation, spam, fraud, scraping, bypassing paywalls, unauthorized access, malware, unlawful content, or redistributing member-only material without permission.

Moderation and Enforcement

Lumsian may review, restrict, remove, or refuse content or activity that appears to violate these Terms, linked policies, law, payment provider rules, or platform safety requirements. Lumsian may suspend or terminate accounts when needed to protect users, the service, or legal compliance.

Third-Party Services

Lumsian may use third-party providers for payments, authentication, hosting, email, communications, video meetings, analytics, security, and other services. Third-party services may have their own terms and privacy policies.

No Warranty

Lumsian is provided on an as-is and as-available basis. To the fullest extent permitted by law, Lumsian disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, security, accuracy, and uninterrupted operation.

Limitation of Liability

To the fullest extent permitted by law, Lumsian and its owners, employees, contractors, vendors, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, service interruption, or unauthorized access.

Disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules.

Informal Resolution

Before starting arbitration or a small claims case, you agree to send a written notice of dispute to support@lumsian.com. The notice should include your name, account email, a description of the dispute, the relief you want, and any documents reasonably needed to understand the issue. Lumsian will try to resolve the dispute informally for 30 days after receiving the notice.

Arbitration Agreement

Except for disputes that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to Lumsian, these Terms, subscriptions, payments, account access, content, or platform use will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable consumer arbitration rules.

The arbitration will be handled on an individual basis. You and Lumsian agree not to bring or participate in class actions, class arbitrations, collective actions, private attorney general actions, or representative proceedings.

Arbitration fees and arbitrator compensation will be allocated under the applicable arbitration provider rules and applicable law. Each party is responsible for its own attorneys, experts, witnesses, and preparation costs unless the arbitrator awards otherwise under applicable law.

Small Claims and Opt-Out

Either party may bring an individual claim in small claims court if the claim qualifies under Washington small claims rules and remains only in small claims court.

You may opt out of the arbitration agreement by emailing support@lumsian.com within 30 days after creating your account or first accepting these Terms, whichever is earlier. Your opt-out notice must include your name, account email, and a clear statement that you opt out of arbitration. Opting out of arbitration does not opt you out of the rest of these Terms.

Changes

Lumsian may update these Terms from time to time. Material changes will be posted on this page or communicated through a reasonable method. Continued use after changes become effective means you accept the updated Terms.
